Dynamiq Cellular Job Site Camera Terms

Last updated: September 26, 2026 (America/Chicago) — added §10 Abandonment and Repossession (expanded triggers + customer access for removal); renumbered §§11–23

These Cellular Job Site Camera Terms (“Camera Terms”) apply to Dynamiq’s Cellular Job Site Camera rentals offered by Dynamiq A/V Integration, LLC (“Dynamiq,” “we,” “us”). They work together with your Squarespace (or other) checkout, invoice, and any written order confirmation. By ordering, paying for, accepting delivery or install of, or continuing to use a Cellular Job Site Camera rental, you agree to these Camera Terms. Where these Camera Terms conflict with marketing copy on a sales page, these Camera Terms control. They work alongside Dynamiq’s general website Terms and Conditions and Privacy Policy where consistent.

Important: These are plain-English commercial terms modeled on common construction-camera lease practices (including public TrueLook lease themes, Caprock-style Limited Damage Waiver (LDW) structure, and local move-limit marketing). They are not legal advice. Have Texas counsel review before public go-live or a dispute.

1 — Agreement and acceptance

A rental is formed when you complete checkout (or accept a Dynamiq invoice/order) and Dynamiq accepts the order. Payment, accepting equipment, or continued use after we post updated Camera Terms is acceptance of the then-current Camera Terms.

Quotes are valid for thirty (30) days unless withdrawn sooner. Dynamiq may decline or cancel an order if you cannot accept delivery/install within a reasonable window after order (for example, three (3) months), unless other arrangements are made in writing.

2 — Definitions

  • Business Hours: Monday–Saturday, 9:00 AM–6:00 PM, America/Chicago, unless Dynamiq publishes different hours. Sunday closed.

  • Camera Package: Dual View (2 cameras), Triple View (3 cameras), Quad View (4 cameras), or another camera count Dynamiq confirms in writing (including Single View or custom counts sold by estimate).

  • Cellular Job Site Camera / Rental: Dynamiq’s rented cellular pan/tilt camera solution (typically solar-assisted) for temporary or ongoing site viewing, including related cellular service path and app viewing as Dynamiq configures for that order.

  • Install Zone / Same General Location: One continuous job site or property area treated as a single building or contiguous pad — not separate buildings, not remote corners of a large campus that require separate truck drops, and not multiple addresses. Dynamiq decides in good faith whether a request is one Install Zone or a split-site job.

  • Limited Damage Waiver (LDW): Optional paid waiver elected at checkout (or later in writing) that reduces your responsibility for covered accidental physical damage under Section 12, subject to exclusions. LDW is not insurance and is not a warranty.

  • Ordinary wear and tear: Natural deterioration from regular, reasonable use. Not dents, bending, tearing, staining, corrosion, misalignment, weather extremes, flooding, customer alteration, lack of care, or other damage outside ordinary equipment-rental wear.

  • Service Area: Greater Houston-area locations Dynamiq regularly serves. Sites outside usual travel range may require extra trip fees or may be declined.

3 — What the rental includes (and does not)

Included (when your order is active and paid): use of the rented camera(s); solar/power method as configured for that order; cellular data path for Dynamiq’s configured viewing; app / cloud viewing access Dynamiq provides; and Dynamiq support during Business Hours for the rented system.

Not included: Texas Department of Public Safety (DPS) licensed monitoring; professional alarm monitoring; guard response; police/fire dispatch; poles or customer structures; mounts above the height limit in Section 7; split-site or multi-building installs at the same-location rate; unlimited moves; new construction wiring; hardwired power or site Wi‑Fi installs; continuous unattended live streaming setups; or any life-safety / medical / high-risk use.

This product is self-view rental with Dynamiq support. Dynamiq is not an insurer. The rental does not prevent theft, vandalism, or loss on your site and does not guarantee detection of every person, vehicle, animal, or event.

4 — Same Install Zone (anti-abuse)

Published Dual / Triple / Quad rates assume all cameras in that package stay in one Install Zone — the same building or contiguous job-site area Dynamiq approved at install.

Not allowed at the packaged rate without a new estimate / written change order:

  • Spreading one package across separate buildings, separate addresses, or distant ends of a site that need separate installs

  • Moving cameras to a second job after the first without a paid relocation / new install

  • Treating “one order” as coverage for multiple unrelated projects

If you need cameras at more than one Install Zone, Dynamiq will quote a Site / multi-drop estimate. Dynamiq may refuse, pause, or reprice service if cameras are relocated or used outside the approved Install Zone without Dynamiq’s written approval.

Camera count changes (for example Dual to Triple) are a new package or change order — not an unlimited right to keep adding cameras at a discounted rate.

5 — Moves and on-site changes (fair use)

Relocation and remount work are not unlimited and are not free labor for construction supervision.

  • Default: Each camera move, building change, or Install Zone change is a separate paid service (trip + labor at then-current rates, or a published relocation product when offered), scheduled during Business Hours.

  • Same Install Zone only: Dynamiq may include one (1) scheduled camera reposition within the approved Install Zone, scheduled at or shortly after initial install — not a recurring monthly allowance — when Dynamiq agrees the move is practical and safe. Extra same-period moves, “chase the crew,” or repeated remounts are billable.

  • Different building / different Install Zone / new address: Always requires an estimate or paid relocation. Packaged Dual / Triple / Quad pricing does not travel to a new site automatically.

  • You must tell Dynamiq before cameras leave the approved Install Zone so billing and support stay accurate.

Call (832) 215-9350 during Business Hours to request a move. Expedited / rush moves, if offered, cost more.

6 — Delivery, damaged shipment, and risk

Unless otherwise agreed in writing, Dynamiq selects shipping/packaging for outbound Dynamiq-owned gear. Report damaged shipment or damaged delivery within twenty-four (24) hours of receipt with photos and a description; keep packaging. Failure to report promptly may limit remedies.

Title to Dynamiq-owned rental gear stays with Dynamiq. Risk of loss for the gear shifts to you when it is delivered to your site or handed to your representative, and stays with you until Dynamiq recovers it in the required return condition.

7 — Mounting, poles, and the 12-foot rule

Customer-furnished mount. If you want a camera on a pole or similar structure, you provide a safe, suitable pole or mount. Dynamiq does not supply poles by default and does not warrant customer-furnished structures.

Stable surfaces only. Equipment must be installed on a safe, stable, structurally sound surface (building, approved pole, trailer, or other secured structure Dynamiq accepts). Do not mount Dynamiq gear to trees, unsecured piping/conduit, or other non-rigid / unstable surfaces. Unsafe mounts may void LDW and may end the rental.

12-foot maximum. Dynamiq installs rented cameras no higher than twelve (12) feet above finished grade (or other reference Dynamiq uses on site). Dynamiq is not obligated to climb, lift, ladder, or install above that height under these Camera Terms.

Above 12 feet. Any request to mount higher than 12 feet requires a separate estimate. Dynamiq may decline for safety, insurance, equipment, or access reasons. Do not place Dynamiq equipment above 12 feet yourself; unauthorized high mounts may void LDW and may end the rental with equipment recovery fees.

You must provide safe site access, a responsible adult on site when required, and conditions suitable for install during Business Hours.

8 — Solar, cellular, and site conditions

Solar and cellular performance depend on sun, weather, trees, buildings, carrier coverage, dust, debris, snow/frost, and construction activity. Coverage maps are estimates only. Outages and speed variation happen. Dynamiq is not liable for carrier or power interruptions.

Your solar care duties (when solar is part of the order):

  • Keep panels reasonably clear of dirt, debris, snow, and shading you can control

  • Do not tamper with, strip, or relocate solar panels or related power gear except as Dynamiq directs

  • Any movement of solar panels / power kits must be done by Dynamiq (or Dynamiq’s authorized tech). Unauthorized moves may incur repair / reinstall fees

  • If site conditions change (new walls, vegetation, parked equipment) so panels need moving, you pay the related service costs

  • Service visits to recharge / replace batteries because of insufficient sun may be billable

Rural, hunting, and animal-detection uses are secondary and still require adequate sun and cellular coverage.

9 — Ownership, care, return, and non-return

Cameras and related Dynamiq gear remain Dynamiq’s property. You will not sell, pledge, encumber, reverse-engineer, or permanently alter the equipment, or remove identifying marks.

On cancellation or Dynamiq’s request, make equipment available for pickup during Business Hours (or return as Dynamiq instructs) within ten (10) days, free from Damage other than Ordinary wear and tear. You keep risk of loss until Dynamiq receives the gear in the required condition.

Billing continues for the rental until Dynamiq recovers the equipment (or you pay replacement as below), similar to common lease practice.

If gear is not returned within thirty (30) days after the rental ends (or Dynamiq’s recovery request), Dynamiq may charge the then-current retail replacement price for missing items and/or retake possession, and may charge recovery costs. You authorize Dynamiq to charge the payment method on file for rent, LDW, taxes, late amounts, loss, damage, non-return, and related recovery costs.

10 — Abandonment and Repossession

Non-payment trigger. If amounts owed under your rental remain unpaid for fourteen (14) continuous days past due, and you do not respond to Dynamiq’s contact attempts by phone, email, or text during that period, the rental is deemed abandoned. Dynamiq may then repossess the equipment under this Section.

Chargeback trigger. Any chargeback, payment dispute, or payment reversal on amounts owed for the rental immediately triggers this Section — no waiting period.

Site abandonment trigger. If the job site or property goes dark — with no personnel or material activity, and Dynamiq’s equipment left unattended — Dynamiq may treat the rental as abandoned and immediately repossess under this Section, with no waiting period.

Unauthorized relocation trigger. Moving cameras or related Dynamiq gear outside the approved Install Zone without Dynamiq’s written approval (already a breach under Section 4) immediately triggers this Section — no waiting period.

Insolvency trigger. If you file for bankruptcy, become insolvent, make an assignment for the benefit of creditors, or have a receiver or similar fiduciary appointed over your assets, this Section triggers immediately — no waiting period.

Illegal-use trigger. Any police report involving the rented cameras or related Dynamiq gear, or evidence that the equipment is being used for illegal activity, automatically and immediately triggers this Section — no waiting period.

Repossession rights. Upon any trigger above, Dynamiq may recover its equipment without further notice or consent from you. That includes pickup during or outside Business Hours; entering the approved Install Zone or any other location where Dynamiq reasonably believes the gear is located; and using reasonable means to locate and retrieve the equipment. You authorize Dynamiq to charge the payment method on file for all recovery costs (trip fees, labor, locksmith / access fees, and related expenses).

Customer access for removal. You must provide Dynamiq (and its authorized technicians) safe, timely access to the job site or property and to the rented equipment so Dynamiq can remove and recover it. That includes unlocking gates, containers, buildings, or other barriers; having a responsible adult available when needed; and not blocking, hiding, or otherwise interfering with recovery. Failure to provide access does not stop billing or repossession rights under this Section or Section 9, and may add recovery costs.

Billing continues. Rental billing continues until Dynamiq physically recovers the equipment, or until you pay the then-current retail replacement price for unreturned items, as described in Section 9.

No waiver. Dynamiq may invoke the rights in this Section at any time after a trigger occurs. Delay in acting does not waive Dynamiq’s rights.

11 — Loss, theft, and damage (without LDW)

Unless LDW applies to a covered event under Section 12, you are responsible if Products are lost, stolen, or damaged beyond Ordinary wear and tear (including misuse, abuse, mishandling, alteration, unauthorized high mounts, or unsafe mounts).

Dynamiq decides whether to repair or replace. If Dynamiq repairs, you pay Dynamiq’s actual repair cost. If Dynamiq replaces, you pay the then-current retail replacement price for a replacement unit that remains Dynamiq’s property and stays under these Camera Terms.

Report loss, theft, or damage promptly. File a police report for theft when Dynamiq requests it.

12 — Optional Limited Damage Waiver (LDW)

If you elect Add Limited Damage Waiver at checkout (or later in writing), you pay the published LDW price for that package (billed as a fixed amount).

When LDW is in force for a covered accidental physical-damage event to eligible Dynamiq rental camera hardware during the paid LDW period, coverage works as follows:

1. Deductible per camera. You pay a flat five hundred dollar ($500) deductible for each damaged camera (or other covered Dynamiq rental unit) involved in the claim.

2. Per-camera limit. After that deductible, Dynamiq covers the remaining covered repair or replacement cost for that camera only up to Dynamiq’s then-current published replacement price for that unit (or Dynamiq’s actual repair cost, if lower). Dynamiq does not pay more than that camera is worth under Dynamiq’s published schedule.

3. Incident ceiling. Across all cameras in a single covered event (for example one storm), Dynamiq’s total LDW payout is capped at ten thousand dollars ($10,000). You pay any covered loss above that combined ceiling, after applying the per-camera deductibles and per-camera limits above.

Published replacement prices. Dynamiq’s then-current replacement values apply. Dynamiq may update that schedule with notice. Until a schedule is posted on this page, Dynamiq will quote the applicable replacement price on request and on any claim.

Examples:

  • One camera, covered damage $800 (replacement price $1,200) → you pay $500; LDW covers $300.

  • One camera total loss at $2,000 replacement → you pay $500; LDW covers $1,500.

  • Five cameras total loss in one storm at $3,000 replacement each ($15,000 total) → you pay $500 × 5 = $2,500 in deductibles; remaining loss $12,500; LDW pays at most the $10,000 incident ceiling; you also pay the $2,500 above that ceiling (plus your deductibles).

Not covered by LDW (non-exhaustive): theft; mysterious disappearance; failure to return; intentional damage; gross negligence; misuse/abuse; unauthorized moves or high mounts; transport damage you cause; cords/batteries/glass as Dynamiq excludes; weather catastrophe Dynamiq’s practices exclude; consequential loss; third-party claims; and other exclusions Dynamiq states in writing.

Customers with qualifying property / inland marine insurance may decline LDW. If you decline, Section 11 applies in full. Dynamiq may require a certificate of insurance naming Dynamiq as loss payee for Dynamiq-owned gear when LDW is declined on larger orders.

13 — Customer responsibilities and prohibited use

You agree to:

  • Use the rental only at the approved Install Zone unless Dynamiq approves a move in writing

  • Keep accurate site / contact information and a responsible adult available for decisions and appointments

  • Use the system for lawful jobsite / property viewing — not to gather biometric identifiers, and not for harassment or illegal surveillance

  • Not represent Dynamiq rental as licensed monitoring or police-response

  • Use live view and recordings reasonably; no unauthorized continuous streaming to signage / media servers without Dynamiq’s written OK (extra fees may apply)

  • Treat Dynamiq staff respectfully; abuse, fraud, or chargeback abuse may end service immediately

Missed appointments / late cancel (less than one (1) Business Day notice) may incur a trip / no-show fee.

14 — Billing, late amounts, term, and annual plans

Monthly plans renew each month until canceled under Dynamiq’s process. Keep a valid payment method on file. Failed payment may pause service and trigger equipment recovery.

Past-due amounts may incur a late fee and interest as Dynamiq’s invoices state (and as allowed by law), plus collection costs including reasonable attorneys’ fees.

Annual plans (where offered: pay eleven (11) months, receive twelve (12) months of service) are prepaid for a twelve-month service term.

Early cancel — annual (no double dip):

  • Default: early cancellation does not prorate and does not refund unused prepaid time.

  • If a refund is required: Refund = annual prepaid amount − (months of service used × the full month-to-month rate for that package), minimum $0. The free-month / annual discount does not apply to months already used.

Dynamiq may change list rates with notice for renewals; continued service after the effective date is acceptance of the new rate for future periods.

15 — Estimates and custom work

One-camera, five-or-more camera, split-site, multi-building, above-12-foot, complex power, or special mounting jobs require an estimate. Marketing package prices do not bind Dynamiq to custom scopes.

16 — Indemnification

Except for Dynamiq’s gross negligence or willful misconduct (where such a waiver would be void), you will indemnify and hold Dynamiq harmless from claims and losses arising out of your use of the rental, your site conditions, your workers/invitees, false expectations of security results, or your breach of these Camera Terms.

17 — Limitation of liability

To the fullest extent allowed by law: Dynamiq is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, stolen materials on site, business interruption, or failed detection), even if advised of the possibility. Dynamiq’s total liability arising out of a Cellular Job Site Camera rental for any claim is limited to the rental fees you paid to Dynamiq for the three (3) months before the claim (or a lesser amount required by law). Nothing here limits liability that cannot legally be limited.

18 — Force majeure

Dynamiq is not liable for delay or failure caused by events beyond reasonable control, including weather, carrier outage, utility outage, supply disruption, site unsafe conditions, or government action.

19 — Marketing photos and on-site signage

Photos and social media. You grant Dynamiq permission to photograph and record the installed Cellular Job Site Camera equipment and reasonable exterior context of the approved Install Zone for Dynamiq’s marketing (including website, social media, proposals, and case studies). Dynamiq will not knowingly publish clear images of identifiable faces of people on your site, or of private documents or screens visible in frame, without your separate written consent. Dynamiq will, when practical, avoid publishing street addresses or other highly identifying location details. You may opt out of future marketing uses of photos of your site by emailing info@dynamiqav.com; an opt-out does not require Dynamiq to remove materials already published in good faith before the opt-out.

Yard signs and fence advertising. During an active rental, you also grant Dynamiq permission to place Dynamiq advertising or identification materials at the approved Install Zone — for example a yard sign on the property being protected, and/or a small advertisement or board along a fence line where other contractor or site advertisements and phone numbers are commonly displayed — in a location Dynamiq and you agree is reasonable and safe. Placards will not block required site access, safety signage, or traffic sight lines. Dynamiq will remove its signs and advertisements when the rental ends (or sooner if you request removal in writing). You may decline or revoke signage permission at install or anytime by telling Dynamiq in writing or by email to info@dynamiqav.com; Dynamiq will remove signs promptly after that notice. Declining signage does not by itself cancel the camera rental.

20 — Privacy and recordings

You are responsible for complying with privacy and recording laws for your site (including notices to workers or visitors where required). Dynamiq may access system status as needed to support the rental. See Dynamiq’s Privacy Policy on dynamiqav.com.

21 — Changes to these Camera Terms

Dynamiq may update these Camera Terms by posting a revised version on this page and/or notifying you by email or invoice. Continued rental after the effective date is acceptance of the updated Camera Terms.

22 — Governing law, venue, and severability

These Camera Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Exclusive venue for disputes is the state or federal courts in Harris County, Texas, unless Dynamiq’s general website Terms require a different forum that counsel confirms should control.

If any provision is unenforceable, the rest remains in effect. These Camera Terms (plus your checkout / invoice and any written order confirmation) are the entire agreement for Cellular Job Site Camera rentals and supersede prior oral statements about this product. You may not assign the rental without Dynamiq’s written consent; Dynamiq may assign to a successor.

Always-On Recording

When Always-On Recording is enabled, the camera attempts to record continuously. Continuous Always-On Recording uses cellular data much faster than motion-triggered recording. In Always-On mode, video is typically captured at a lower frame rate (about four to five frames per second (FPS) when conditions allow). Higher-quality video is used when Live View is opened, an event is triggered, or motion is detected. Actual continuity, frame rate, and quality depend on signal, power, weather, and device conditions. Customer is responsible for any overage or plan limits that result from Always-On Recording, Live View use, or frequent event playback.
